Made a Voluntary Announcement that she lived on Magpie Hall Road, at some distance from the application site, and so might be personally affected by any odour issues.

 

Declared that she was a member of the Campaign for the Protection of Rural England (CPRE) but had had no involvement in the letter from Richard Buxton solicitors.

 

Declared that she served on Kingsnorth Parish Council, who had made objection to the application. She would not propose a motion, nor vote on the application; she did not do so.

The Democratic Services Officer advised that registered public speakers had been invited either to address the Committee in person, or to have their speech read out by a designated Council Officer who was not from the Planning Department.  On this occasion there were four registered speakers, all of whom were present to deliver their speeches in person.

REFUSE for the following reasons:

 

 

1.         The proposed development would be contrary to the Chilmington Green Area Action Plan (CGAAP) ‘Vision’ and policies CG0 & CG1, paragraph 135 (c) of the NPPF, and the Ashford Local Plan (2030) policies SP1 & ENV3a for the following reason:

 

The approved Chilmington Green (CG) parameter plans, derived from the development principles set out in the CGAAP, seeks to retain the application site as part of an area of undeveloped green space with a distinctive open landscape character (complemented by a future extension to the Stubbcross Wood ancient woodland) in order to create a contextually appropriate, well-designed, ‘green’ edge to the CG development. This approach protects the visual amenity of both existing and future residents by ensuring that the character of the landscape is retained and can be appreciated from a variety of locations, including from both higher ground and the planned nearby strategic public space (‘Discovery Park’) located within the CG development. Due to its size, scale, layout, appearance and cumulative impact in association with the nearby Southern Water pumping station, the proposed Waste Water Treatment Plant would have a significant detrimental visual impact on such landscape character and, in turn, on the achievement of a well-designed CG development in accordance with the CGAAP principles.

 

 

2.         Insufficient evidence has been submitted to the local planning authority to provide confidence that the proposed Waste Water Treatment Plant would be granted a Discharge Permit and delivered and operated in accordance with the details set out in the application without giving rise to an unacceptable risk to local watercourses (which from the information currently available to the local planning authority appear to have limited / seasonal flow) resulting in groundwater pollution and, in turn, downstream adverse environmental effects on the river Beult and the river Beult SSSI due to the quality and/or quantity of treated wastewater flowing into that sensitive environment. Consequently, the proposed Waste Water Treatment Plan has the potential to be contrary to the Chilmington Green Area Action Plan (CGAAP) policies CG0, CG1 & CG21, paragraphs 180 (e) and 186 (b) of the NPPF, and the Ashford Local Plan (2030) policies SP1, ENV1 & ENV8.

 

 

3.         Insufficient evidence has been submitted to the local planning authority to provide confidence that nearby residents and businesses would not be at an unacceptable risk of being adversely affected by odour emissions arising from the operation of the Waste Water Treatment Plant. Consequentially, the proposed Waste Water Treatment Plant has the potential to be contrary to the Chilmington Green Area Action Plan (CGAAP) policies CG0 & CG1, paragraph 180 (e) of the NPPF and the Ashford Local Plan (2030) policy SP1.
